1. Definitions:
In these Terms and Conditions:
Goods or Services means one or more products or services ( as determined by the Promoter/Participating Merchant) offered for purchases by a Participating Merchant in theWedding Rewards Program, the purchase of which will entitle the Member to a reward.
Merchant means the participating merchant at which the Member was issued their wedding rewards card and at which the Member has established their wedding rewards Membership.
Member means a person aged over 16 years or over who has been issued with, and continues to hold, a valid wedding rewards card. Wedding Rewards Cards can only be issued for personal use by the Member.
Participating Merchant means the Merchant participatig in the program, as nominated by the Promoter from time to time.
Program means the Wedding Rewards Program.
Program Term, this program will continue for an idefinite period until such time as it is terminated by the Promoter in accordance with these Terms and Conditions.
Reward means a current good or service offered as being available for redemption by a Member upon booking or purchasing the good or service, or as otherwise advertised by the Promoter from time to time.
Wedding Rewards Card means the card issued to a Member by the Promoter pursuant to the Member's involvement in the Program.
2. Becoming a Member & Wedding Rewards Cards
2.1 To become a Member, patrons must fully complete an official Wedding Rewards Application Form at a Participating Merchant and present appropriate identification bearing their name and photograph/signature or complete the wedding rewards online application form. Members my only apply for membership under this Program in their individual capacity. Businesses and other commercial entities are not eligble to participate in the Program.
2.2 The Promoter may, in its absolute discretion, refuse an application for membership. An application for membership is not valid until formally approved by the Promoter and a Wedding Rewards Card is issued. Wedding Reward Cards are not credit or charge card, and are transferable.
2.3 The Member must immediately notify the Promoter (via email) of any changes to the Member's personal details (as provided on the application form) including but not limited to change of address details.
2.4 In the event of loss or theft of a Wedding Rewards Card it is the Member's responsibility to immediately notify the Promoter, the Promoter amy, in its absolute discretion, issue a replacement Wedding Rewards Card. Neither the Promoter nor any Participating Merchant will be liable for unauthorised use of a lost or stolen Wedding Rewards Card, or any delay in replacing a Members lost or stolen Wedding Rewards Card. The Promoter may, in its absolute discretion, charge a fee which at present is $5 for each replacement Wedding Rewards Card issued.
3. Rewards
3.1 Claiming Rewards
Members must present thier valid Wedding Rewards Card at the time of purchase or booking to be eligible to recieve the wedding reward. the Promototer is not liable for any failure of a Member to notify Participating Merchnatsthat the purchase or booking is a Wedding Rewards transaction. It is at the absolute discretion of the Participating Merchant whether to award the Wedding Reward at a later date or not.
3.2 Reward Offers
Members cannot claim a Reward unless he/she has a valid Wedding Rewards Card (as specified by the Promoter in its absolute discretion, or by a Participating Merchant in its absolute discretion, as the case may be) and he/she has paid for the Goods or Services attracting the wedding Reward. The Promoter, or Participating Merchant may vary the requirements for the Reward at any timewithout notice for any reason whatsever.
3.3 Reward claims must be directed to a Participating merchant in accordance with the relevant claiming procedures specified in each case. For security reasons, claims for Rewards must be made by the Member personally. Rewards will only be made available in the name of the Member.
3.4 Rewards are not redemable for cash and are not transferable or assignable. Each Reward is subject to the specified Reward conditions, which are provided to Members by the Participating Merchant. Rewards must be taken or redeemed by the date set out in the Reward conditions, in each case.
3.5 Any Rewards not used or redeemed by the set date as set out in the Reward conditions will be automatically forfeited by the Member unless the Participating Merchant agrees to an extension which they may do in their absolute discretion.
3.4 The Wedding Rewards are offered to Members by entities with which the Promoter has made arrangements but over which the Promoter has no control. Arrangements and utilisation of Rewards offered by third parties through the Program are made by the promoter solely as agent for the entity providing such Rewards. The provision of Rewards will be subject, in each case, to the terms and conditionsof each entity providing such Rewards and this shall constitute the sole contract between the entity providing the Reward and the Member. Without limiting the generality of this clause the Proomoter gives no warranty with respect to the quality, merchantability, fitness for purpose, safety or availability of the Rewards supplied to Members in connection with this Program. The Promoter shall not be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consquential loss) or personal injury suffered or sustained, from taking a Rewardexcept for any liability which cannot be excluded by law. In addition, the Promoter will not be liable for any loss, theft, or damage to any Reward in the course of post or delivery.
3.6 The Rewards are listed at the absolute discretion of the Promoter and the Promoter expressly reserves the right to wwithdraw, cancel, vary or inany way change at any time without notice any of the Rewards listed or advertised as available to a Member under this Program.In that event, the Promoter shall not be held liable for any loss or cancellation, variation or change. All Rewards are subject to availability and the Promoter does not guarantee in any way that the Rewards listed under the Program will be available.
4. Extra Rewards
4.1 Bonus Rewards
Bonus Rewards may also be available during the course of various promotional activities offered by the Promoter/Participating Merchant from time to time.
5. Termination of Membership/Suspension or termination of Program.
5.1 The Member accepts these Terms and Conditions as amended from time to time and agrees to be bound by them. participation in the Program is subject to these Terms and Conditions and any rules, policies or procedures ('Program Rules') that may be adopted by the Promoter from time to time. Any failure by the Member to comply with these Terms and Conditions, and the Program Rules, or any misrepresentations of information to the Promoter or its agents, may result in the termination of a Member's registration in the Program. The Promoter reserves the right at any time in its absolute discretion and without notice to revoke the registration of a member in the Program and in the event that a Member's registration in the Program is revoked by the Promoter any Rewards booked may be cancelled, at the discretion of the Promoter or Participating Merchant.
5.2 A Member may terminate his/her membership in this Program at any time by giving written notice to the Promoter. On recieving a notice of termintation from the Member, the Member's contact details will be noted on the Promoter's database as closed, and the Wedding Rewards Card cancelled. Unless otherwise notified by the Member at the time of termination, the Memeber's details will be retained on the Promoter's database for a further period of 12 months from the wedding date given on application of the Wedding Rewards Card, after which time they will be deleted.
5.3 The Promoter may immediately terminate, suspend or vary the Program (in whole or part), or add or remove Participating Merchants, at any time without prior written notice to Members and without assigning any reason therefore. The Promoter shall not be liable for the termination/cancellation, suspension or variation of the Program, or the removal of a venue as a Participating Merchant, on any account whatsoever including (without limitation) for any Reward booked at the time of suspension or cancellation. The Merchant may in its absolute discretion continue to provide the Reward to the Member.
6. General
6.1 These Terms and Conditions (including Reward listings, Reward conditions, Program rules, and participating Merchants) may be changed, amended or varied at any time by the Promoter in its absolute discretion without notice and without assigning any reason therefore. if the Promoter intends to vary the Terms and Conditions, it will post the notice of the varied Terms and Conditions in a prominent place on www.weddingrewards.com.au. the varied Terms and Conditions will take effect immediately from that date specied in the notice of variation. The Member's continued use of the Wedding Rewards Card after the variation takes effect will constitute acceptance of the variation, and the new Terms and Conditions will govern the Members use of the Wedding Rewards Card and participation in the Program.
6.2 The Promoter's decision on all matter pertaining to this Program is final and binding.
6.3 Liability for any tax or any other government charges on any benefits provided to Members pursuant to this Program shall be the sole responsibility of all Members. it is recommended that Memebers should contact their own Accountant or Taxation Advisor in this regard.
6.4 The Program, the Promoter and all Members shall be subject to all statutes, by-laws, regulations and government policies and/or industry association policies relating to promotional activities in each state and territory of Australiaand Members must comply with all directions and/or recommendations of the Promoter and the Memebers participation in the Program and use of the Wedding Rewards Card in thie regard, which may include restricting or terminating cancelling the Program.
6.5 These Terms and Conditions shall be governed by and construed in accordance with the laws in force in the various States and Territories in Australia.
6.6 A notice shall be deemed to be given by the promoter to a Member if it is is sent to the postal address or email address of the member, as shown on the Promoter's records.
